Job Information: 

Our client, one of the most successful financial companies that deal with prepaid cards and a new alternative banking market, are looking to recruit a Senior Legal Counsellor to join their expanding team at their EU Headquarters in Gibraltar. The role involves the ability to understand how to develop and maintain a commercially focused practical legal framework, function and culture across multiple jurisdictions and business lines. The successful applicant will be highly motivated with a pro-active approach to problem solving and the confidence to trust in their own ability to find answers and advise on what is required to deliver what the business needs.
Your primary responsibility will be advising on mainly European aspects of regulations, partnership agreements, processing agreements, consumer law, data protection, IP, marketing, distribution deals and general commercial agreements, and if that’s not enough there may also be some interesting M & A activity.
You will be required at act as the lead advisor to the General Counsel and manage colleagues to ensure quality, consistent and compliant management of the legal function to the rest of the business across all of their offices, including UK, India and Bulgaria.
You should be able to think on your feet, produce high quality work, be flexible in a fast paced environment, and be able to work for clients located around the world. You should also be comfortable in dealing with people in finance, marketing, sales, compliance and operations and be able to conduct training from board level directors to colleagues in any area of the business.
This is a job that will provide and interesting challenge in a new, emerging sector.

Job Responsibilities: 

• Advise on legal, contractual & regulatory issues and risks in relation to the business
• Great contract drafting and reviewing skills
• Develop and maintain localised precedent documents in relation to our products and programs
• Find, instruct and manage external counsel in multiple jurisdictions
• Liaise with regulators and industry associations
• Assist with fraud and AML issues
• Help build relationships of trust with European banks and other payment service providers on issues of fraud management and data sharing
• Liaise with senior employees at MasterCard and Visa on card related issues
• Significant overlap with our compliance function
• Provide training on legal issues and aspects of our business to colleagues and partners
• Provide the General Counsel advice as required on all aspects of financial services, regulatory, contract and commercial law.

Candidate Skills: 

• BA/BSc degree or local equivalent preferred
• Intelligent and diligent detail orientated person that is also good with people
• Qualified lawyer with law firm experience in the UK or with an in-house team at a regulated financial services organisation
• Experience working with clients on multi-jurisdictional transactions
• Ability and confidence to influence decision makers
• Ability to think at a macro and micro-level, strategic and tactically minded
• Understanding of the commercial and competitive nature of cross-border regulatory issues
• Experience in advising and/or implementing cross border legal solutions across multiple European countries strongly preferred
• Experience of data protection and intellectual property issues
• Excellent written and oral skills in English
• Good sense of humour
